DMCA Policy

Grilled Peanut Butter And Jelly (referred to herein as "we", "us", or "our") respects the intellectual property rights of others. We comply with the provisions of the Digital Millennium Copyright Act (DMCA) and will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our service, please notify our designated Copyright Agent as set forth below.

Filing a DMCA Notice

To file a notice of infringement with us, you must provide a written communication (by email or regular mail) that sets forth the information specified in the DMCA. Please be aware that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material or activity is infringing your copyrights. We recommend that you consult with a legal advisor before filing a DMCA notice.

Your DMCA Notice must include substantially the following:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the material that you claim is infringing and where it is located on our service, including, at a minimum, the URL of the infringing material.
  4. Information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and e-mail address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a DMCA Counter-Notification

If you believe that material you posted on our site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. Please be aware that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material or activity is not infringing the copyrights of others. We recommend that you consult with a legal advisor before filing a counter-notification.

To file a counter-notification, you must provide a written communication (by email or regular mail) that sets forth the information specified in the DMCA. Your counter-notification must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Grilled Peanut Butter And Jelly may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
